First Degree DWI:

Second Degree DWI:  

Gross Misdemeanor DWI is punishable by up to 365 days in jail and or $3,000 fine.  A Second fourth degree DWI is generally charged in Minnesota when an individual is in physical control or operating a motor vehicle and two aggravating factors are present(e.g., prior DWI within 10 years, blood alcohol concentration – BAC – of 0.20 or more, or children in the vehicle ).  Second Degree DWI may also be charge if the individual refused to take a test to determine his or hers blood alcohol concentration and one aggravating factor is present. 

Third Degree DWI:

Gross Misdemeanor DWI is punishable by up to 365 days in jail and or $3,000 fine.  A third degree DWI charge may occur when an aggravating factor is present (e.g., prior DWI within 10 years, blood alcohol concentration – BAC – of 0.20 or more, or children in the vehicle ) and the individual was operating or in physical control of a motor vehicle while intoxicated.  Minnesota law also allows for Third Degree DWI charge if the individual refused to take a test to determine his or hers blood alcohol concentration.   

Fourth Degree DWI: 

Misdemeanor DWI is punishable by up to 90 days in jail and or $1,000 fine.  A fourth degree DWI charge in Minnesota generally occurs when an individual has no other driving while impaired convictions within the last ten years and was operating or in physical control of a motor vehicle while intoxicated.  This is the lowest level charge for DWI in Minnesota.  If an individual charged with DWI did not take a chemical test (e.g., breath, blood, urine) then her or she is not charged with a Fourth Degree DWI in Minnesota.  Additionally, no aggravating factors (e.g., prior DWI within 10 years, blood alcohol concentration – BAC – of 0.20 or more, or children in the vehicle ) must be present for an individual charged with Fourth Degree DWI.
