A Wisconsin Appeals Court ruled that drunken driving laws apply even to people driving on a frozen lake.

Todd Anderson was arrested and charged with drunk driving after he was found to have a blood alcohol content of 0.365 while driving an SUV on a frozen lake in January of 2011. According to state statute, Wisconsin drunken driving laws apply to "premises open to public motor vehicle use." The judge reasoned that a frozen lake was not a premise open to public motor vehicle use, and dismissed the charges against Anderson.

The State appealed the judge's dismissal order, and the Appellate Court determined that "premises" is a vague term and, as such, includes lakes. Therefore, the case has been remanded back to district court.
